Training Providers to Comply with ASQA’s Legislative Obligations
Under the Education Services for Overseas Students (ESOS) Act and the National Code, training providers delivering Vocational Education and Training (VET) qualifications to international students must comply with ASQA’s legislative obligations.
These obligations include:
- Refraining from misleading or deceptive conduct during student recruitment and course provision.
- Providers are also prohibited from disseminating false or misleading information or making guarantees regarding migration outcomes in their marketing activities.
- Marketing and promotional efforts must adhere to the principles of Australian Consumer Law, ensuring that they do not misrepresent courses or education services.
ASQA is actively collaborating with various government agencies to bolster compliance activities and surveillance and monitoring initiatives. Whenever concerns regarding provider practices are raised, the authority will work in conjunction with these entities to ensure that necessary actions are taken.
To reiterate their expectations and outline the steps, ASQA has communicated directly with all providers registered under the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS).
