The Australian Skills Quality Authority (ASQA) has declared its commitment to regulating education delivery to this demographic to protect international students from unethical practices. ASQA’s focus on the issue aligns with the government’s broader efforts to address concerns surrounding third-party education agents and their involvement in the recruitment process.

Training Providers to Comply with ASQA’s Legislative Obligations

Under the Education Services for Overseas Students (ESOS) Act and the National Code, training providers delivering Vocational Education and Training (VET) qualifications to international students must comply with ASQA’s legislative obligations.

These obligations include:

  • Refraining from misleading or deceptive conduct during student recruitment and course provision.
  • Providers are also prohibited from disseminating false or misleading information or making guarantees regarding migration outcomes in their marketing activities.
  • Marketing and promotional efforts must adhere to the principles of Australian Consumer Law, ensuring that they do not misrepresent courses or education services.

ASQA is actively collaborating with various government agencies to bolster compliance activities and surveillance and monitoring initiatives. Whenever concerns regarding provider practices are raised, the authority will work in conjunction with these entities to ensure that necessary actions are taken.

To reiterate their expectations and outline the steps, ASQA has communicated directly with all providers registered under the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS).

However, the growing influence of third-party education agents has raised concerns about the system’s integrity.
